Nomafii Terms of Service

These Terms of Service ("Terms") govern your use of the Nomafii mobile application and any related services (collectively, the "Service") provided by Nomafii ("we," "our," or "us"). By creating an account or using the Service, you agree to be bound by these Terms.
1. Eligibility
You must be at least 18 years old to use Nomafii.
By using the Service, you represent and warrant that you are at least 18 years old.
2. Your Account
You are responsible for all activity that occurs under your account.
You must provide accurate registration information and keep it up to date.
You may not transfer your account to anyone else.
You may delete your account at any time within the app.
We may restrict, suspend, or delete your account if you provide false information, impersonate another person, or violate these Terms.
3. Acceptable Use
You agree not to use the Service for any of the following purposes or in any of the following ways:
- Soliciting dating, romantic, or sexual encounters. Nomafii is a networking service for travelers and digital nomads.
- Harassing, threatening, defaming, or impersonating any person.
- Posting or transmitting sexually explicit, discriminatory, violent, or illegal content.
- Sending spam, scams, multi-level marketing pitches, or unsolicited commercial messages.
- Attempting to access, probe, interfere with, or compromise the Service or its security.
- Collecting, extracting, or scraping data from the Service in bulk.
- Accessing the Service through bots, crawlers, scrapers, or other automated means.
- Decompiling, disassembling, reverse engineering, or otherwise attempting to derive the source code or underlying structure of the Service.
- Registering false information or creating an account by impersonating another person.
- Holding or using multiple accounts without our consent.
- Infringing the copyrights, trademarks, privacy rights, publicity rights, reputation, property, or other rights or interests of us, other users, or any third party.
- Engaging in conduct that causes harm, fear, nuisance, or disadvantage to other users.
- Violating applicable laws, public order and morals, these Terms, our Community Guidelines, or any rules established by us.
4. Content You Submit
You retain ownership of the content you submit or transmit through the Service, including profiles, photos, messages, and posts.
However, solely for the purpose of operating, providing, improving, displaying, storing, distributing, and moderating the Service, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to use such content.
You are solely responsible for the content you submit and represent and warrant that you have all necessary rights to submit it.
If we determine that submitted content violates these Terms, our Community Guidelines, applicable law, or the safe operation of the Service, we may remove, hide, or restrict such content without prior notice.
5. Our Intellectual Property Rights
All copyrights, trademarks, and other intellectual property rights in and to the Service and all related software, programs, source code, systems, designs, UI, UX, logos, trademarks, service names, text, images, illustrations, icons, and other content, excluding user-submitted content, belong to us or to third parties who have licensed such rights to us.
The permission granted to you to use the Service under these Terms does not transfer or license to you any intellectual property rights owned by us or any third party.
Without our prior written consent, you may not copy, reproduce, modify, adapt, distribute, sell, rent, publicly transmit, commercially exploit, reverse engineer, decompile, disassemble, or otherwise use any part of the Service in a manner that infringes the rights of the rights holder.
6. Events and Offline Interactions
Nomafii allows users to create, view, join, and interact around events and other users.
Participation in events, meeting other users, offline interactions, travel, visiting meeting locations, and any real-world actions arising through the Service are undertaken at your own discretion and responsibility.
We are not the organizer, travel agent, broker, guarantor, or supervisor of any event. We do not guarantee the content, occurrence, safety, legality, participants’ conduct, meeting locations, transportation, or any real-world circumstances related to any event.
When participating in events or meeting other users, you are responsible for taking appropriate safety precautions, including meeting in public places, sharing your plans with trusted persons, and leaving immediately if you feel unsafe.
Except where caused by our willful misconduct or gross negligence, we are not liable for any accidents, injuries, illness, theft, loss, trouble, crime, damages, disputes between users, or any other incidents that occur offline.
7. Disputes Between Users
Any communications, event participation, messages, transactions, promises, trouble, disputes, damages, or other issues arising between users must be resolved between the relevant users.
We may, where appropriate, respond to reports, restrict accounts, remove content, or take other safety measures, but we are not obligated to resolve disputes between users.
Except where caused by our willful misconduct or gross negligence, we are not liable for any disputes between users or damages arising from user conduct.
8. Location Information
The Service may use your location information or selected city information to provide nearby events, users, city information, recommendations, map displays, and other features.
You may allow or disable the use of location information through your device or app settings. However, if you disable location information, some features may be unavailable or may not function accurately.
We do not guarantee the accuracy, completeness, or real-time availability of location information, map displays, distances, event locations, displayed user locations, or recommendations.
You are responsible for using maps, location information, distance displays, and nearby information at your own discretion and risk.
9. Face Verification Badge
Nomafii may provide a Face Verification Badge or similar indicator to show that a face is clearly visible in a profile photo.
The Face Verification Badge only indicates that a face appears to be visible in the profile photo. It does not constitute identity verification, personal identification, age verification, a guarantee of real-world existence, background verification, criminal record screening, or a guarantee of safety.
We do not guarantee the identity, trustworthiness, safety, conduct, or accuracy of profile information of any user who has a Face Verification Badge.
Whether or not a user has a Face Verification Badge, you are responsible for interacting with other users at your own discretion and risk.
10. Personal Information and Privacy
Personal information, location information, usage data, device information, and other data that we collect through the Service will be handled in accordance with our Privacy Policy.
By using the Service, you agree that we may collect, use, store, and share your data in accordance with our Privacy Policy.
The Privacy Policy forms part of these Terms.
11. Reporting, Blocking, and Moderation
You may report or block other users from within the app.
If we determine that a user has violated, or may violate, these Terms, our Community Guidelines, or our safety standards, we may, without prior notice, remove content, restrict visibility, restrict features, temporarily suspend the account, permanently suspend the account, or prohibit access to the Service.
We may immediately suspend or ban an account if we determine that there has been a report from another user, a safety concern, suspected misuse, nuisance behavior, illegal conduct, involvement with anti-social forces, or conduct that interferes with the healthy operation of the Service.
These decisions will be made at our reasonable discretion.

12. Subscriptions, Auto-Renewal, and Service Levels
Nomafii offers auto-renewable subscriptions ("Nomafii Premium").
Payment will be charged to the payment method selected by you at purchase confirmation and at each renewal.
Unless you cancel before the end of the current subscription period, your subscription will automatically renew.
Unless the price is changed, the same price will apply upon renewal.
An introductory free trial may be offered at purchase.
If you cancel during the free trial period, you will not be charged.
After the free trial ends, the regular subscription price will apply.
You can manage or cancel your subscription through the account settings of the platform or payment service used for the purchase.
Deleting the app does not cancel an active subscription.
Nomafii Premium provides access to certain features or additional functions of the Service. It does not guarantee continuous operation of the Service, any specific uptime, response speed, availability, data retention, completeness of features, or any particular outcome.
We do not provide any service level agreement (SLA), uptime guarantee, refund guarantee, service credit, or compensation based on downtime for the Service, including Nomafii Premium.
Even if all or part of the Service becomes unavailable due to system failure, maintenance, communication environment, third-party service failure, specification changes, traffic congestion, security response, or any other reason, we are not obligated to provide any refund, reduction, compensation, or extension of the service period, except where required by applicable law, the policy of the platform or payment provider used for the purchase, or where caused by our willful misconduct or gross negligence.
The Service is provided on a best-effort basis, and you understand this when purchasing or using Nomafii Premium.
13. Refunds
Refunds for subscriptions are handled in accordance with the policies of the platform or payment provider used for the purchase.
If you wish to request a refund, please follow the instructions provided by the platform or payment provider used for the purchase.
Except as otherwise provided in these Terms or required by applicable law, we do not provide refunds, reductions, compensation, or extensions of the service period due to temporary suspension, interruption, system failure, maintenance, third-party service outages, your communication environment, or non-use for reasons attributable to you.
14. Third-Party Services
The Service may use third-party services, software, APIs, SDKs, and platforms to provide maps, location information, payments, subscription management, authentication, cloud storage, notifications, analytics, image processing, and other functions.
When using the Service, you must comply with the terms of service, privacy policies, and other conditions of such third-party services.
We do not guarantee the content, accuracy, availability, continuity, security, failures, specification changes, suspension, or termination of any third-party service.
Except where caused by our willful misconduct or gross negligence, we are not liable for any damages arising from the use or unavailability of any third-party service.
15. App Store Terms
If you obtain and use the app through the App Store, Google Play, or any other app distribution platform (collectively, "Platform Providers"), you must comply with these Terms as well as the terms, guidelines, and other conditions established by the relevant Platform Provider.
These Terms are entered into between you and us, not with Apple Inc., Google LLC, or any other Platform Provider.
We, not the Platform Providers, are responsible for the app and the Service.
The Platform Providers are not responsible for the content, maintenance, support, warranties, user or third-party claims, product liability, legal compliance, consumer protection, privacy, intellectual property infringement claims, or any other matters relating to the Service.
For users who obtain the app through the App Store, Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple has the right to enforce these Terms against you as a third-party beneficiary.
You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
16. Suspension and Termination
You may stop using Nomafii at any time.
We may suspend or terminate your access if you violate these Terms or if there are operational, safety, technical, legal, or business reasons related to the Service.
Upon suspension or termination, your right to use the Service will immediately cease.
The handling of data upon account deletion is described in the Privacy Policy.
17. Changes, Interruptions, and Termination of the Service
We may, at our discretion, change, add, restrict, suspend, interrupt, or terminate all or part of the Service at any time.
We will endeavor to provide prior notice where reasonably possible. However, we may suspend, interrupt, or terminate the Service without prior notice in the event of emergency maintenance, security issues, legal compliance, third-party service outages, technical failures, business decisions, or other unavoidable circumstances.
Except where caused by our willful misconduct or gross negligence, we are not liable for any damages arising from changes, interruptions, suspension, or termination of the Service.
18. Feedback
If you provide us with ideas, suggestions, requests, improvement proposals, feedback, or other information relating to the Service, we may use such feedback for improving, developing, operating, marketing, or otherwise conducting our business without paying any compensation to you.
Such use will be royalty-free, perpetual, non-exclusive, sublicensable, and irrevocable.
You agree not to assert any moral rights or similar rights in relation to our use of such feedback.
19. Exclusion of Anti-Social Forces
You represent and warrant, now and in the future, that you are not a member of an organized crime group, a member of such group, an associate member of such group, a company affiliated with such group, a corporate racketeer, a person or group engaging in criminal activities under the pretext of social campaigns or political activities, a special intelligence violent group, or any other person equivalent to the foregoing (collectively, "Anti-Social Forces"), and that you do not have any socially condemnable relationship with Anti-Social Forces.
You covenant that you will not, by yourself or through any third party, engage in violent demands, unreasonable demands, threatening words or behavior, spreading rumors, using fraudulent means or force to damage our credibility or obstruct our business, or any similar conduct.
If you violate this section, we may suspend or delete your account or terminate your use of the Service without any notice or demand. Except where caused by our willful misconduct or gross negligence, we are not liable for any damages incurred by you as a result.
20. User Liability for Damages
If you cause damages to us through a violation of these Terms, fraudulent conduct, illegal conduct, or any reason attributable to you, we may claim compensation from you for damages, costs, losses, reasonable attorneys’ fees, investigation costs, and response costs incurred by us.
If you cause a dispute with a third party in connection with the Service, you must resolve it at your own cost and responsibility. If we incur costs or damages in connection with such dispute, you must compensate us for them.
21. Disclaimers
The Service is provided "AS IS" and "AS AVAILABLE."
We make no express or implied warranties regarding the Service, including merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, safety, continuity, or usefulness.
We do not guarantee the accuracy, reliability, safety, or usefulness of users, events, places, messages, profiles, photos, recommendations, map information, location information, or any other information displayed through the Service.
This section and other disclaimer provisions in these Terms do not apply to damages caused by our willful misconduct or gross negligence.
22. Limitation of Liability
Except where caused by our willful misconduct or gross negligence, we are not liable for damages incurred by you in connection with your use of the Service.
Notwithstanding the preceding paragraph, if we are liable to you for damages, including liability based on default or tort arising from our ordinary negligence, our liability will be limited to the total amount of fees you paid to us during the one-month period immediately preceding the time when the damages occurred. This limitation does not apply where damages are caused by our willful misconduct or gross negligence.
Except where caused by our willful misconduct or gross negligence, we are not liable for indirect, incidental, special, consequential, or punitive damages, lost profits, loss of data, or loss of business opportunities arising from or related to your use of the Service.
This section and any other provisions in these Terms that exempt or limit our liability do not apply to damages caused by our willful misconduct or gross negligence.
23. Notices
We may provide notices to you by in-app display, push notification, email to your registered email address, posting within the Service, posting on our website, or any other method we deem appropriate.
If we send a notice to your registered email address, it will be deemed to have reached you at the time it would normally be delivered.
You must keep your registration information and notification settings accurate and up to date.
24. Changes to These Terms
We may modify these Terms from time to time.
When we make material changes, we will indicate the new effective date at the top of this page and notify you in-app or by email where appropriate.
Your continued use of the Service after the changes take effect constitutes your acceptance of the revised Terms.
25. General Provisions
25.1 Severability
If any provision or part of a provision of these Terms is held invalid or unenforceable under the Consumer Contract Act or any other applicable law, the remaining portion of that provision and the other provisions of these Terms will remain in full force and effect.
We and you will cooperate in good faith, to the extent necessary, to replace the invalid or unenforceable provision with a valid provision that most closely reflects the original intent.
25.2 Assignment
You may not assign, transfer, pledge, or otherwise dispose of your status under these Terms or any rights or obligations under these Terms without our prior written consent.
If we transfer the business relating to the Service to a third party, including by business transfer, company split, merger, share transfer, or any other form of business succession, we may transfer our status, rights, obligations, your registration information, usage data, and other information relating to the Service to the transferee, and you hereby consent to such transfer in advance.
25.3 Survival
Even after account deletion, termination of use of the Service, or termination of these Terms, the provisions regarding submitted content, intellectual property rights, disputes between users, Face Verification Badge, personal information and privacy, third-party services, App Store terms, feedback, exclusion of anti-social forces, user liability for damages, disclaimers, limitation of liability, general provisions, governing law and jurisdiction, and contact will continue to apply to the extent required by their nature.
26. Governing Law and Jurisdiction
These Terms are governed by the laws of Japan, without regard to its conflict-of-law principles.
Unless otherwise required by mandatory law, any dispute arising out of or relating to the Service will be subject to the exclusive jurisdiction of the courts of Japan.
